Some of the most common examples of violations of citizens’ rights include:

  • Police must advise a citizen of his or her rights. This includes the right to speak with an attorney before telling law enforcement anything. They will often talk you into a corner, trying to make you say something that will incriminate you, whether it is true or not.
  • By law, you cannot be pulled over by police without reasonable suspicion. Law enforcement will often stop a citizen for insignificant reasons, such as unreasonable issues with the license plate or an alleged traffic violation. Police may tell you that they pulled you over for an equipment violation or a suspected issue with your car. These are insufficient reasons to pull over a driver.
  • If you have been stopped, you have the right to refuse substance testing, such as a Breathalyzer or a field sobriety test. While refusal carries legal consequences, the citizen cannot be forced to take the test.
  • There are specific laws and protocol in place regarding how police can search your person, including pat-downs and reaching into your pockets. Police must also have probable cause to search your vehicle.
